Terms of Service & Membership Terms

1. Agreement to These Terms

These Terms of Service and Membership Terms (collectively, the “Terms”) are a binding agreement between you and Explore Occasions (“Explore Occasions,” “we,” “us,” or “our”). By accessing or using ExploreOccasions.com, creating an account, starting a trial, purchasing or maintaining a membership, or using services made available through Explore Occasions, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the services or start a membership. Certain travel products and services are provided or fulfilled by third-party suppliers and may also be subject to separate supplier terms, fare rules, cancellation policies, and privacy practices.

2. Eligibility, Accurate Information & Account Security

You must be legally capable of entering into a binding agreement and must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account. You agree to notify us promptly of suspected unauthorized use.

Memberships are intended for the enrolled member and may not be resold, transferred, shared for commercial use, or used to provide unauthorized access to member-only rates or services.

3. Explore Occasions Membership

Explore Occasions provides travel technology, member access, travel-search and comparison features, and access to travel products or services offered directly or through third-party suppliers. Membership benefits, features, inventory, suppliers, and technology may evolve over time.

Your membership fee is separate from charges for hotels, resorts, rental cars, flights, vacation rentals, activities, insurance, cruises, packages, taxes, resort fees, supplier fees, and other travel products or services.

4. Founding Member 14-Day Free Trial

Eligible new Founding Members receive a 14-day free trial beginning when enrollment is successfully completed. A valid payment method is required to start the trial. The annual membership fee is not charged at enrollment.

Unless you cancel before the end of the 14-day trial, you authorize Explore Occasions and its payment processor to automatically charge your payment method $99 for your first year of Founding Member membership. The paid annual membership begins immediately after the trial ends.

Trial eligibility may be limited to one trial per person, household, payment method, or account, and we may refuse or revoke trial eligibility where we reasonably determine that a trial has been duplicated, abused, manipulated, or obtained through fraud.

5. Automatic Renewal & Recurring Billing Authorization

By starting the trial and providing a payment method, you expressly authorize Explore Occasions and its payment processor to store the payment method and charge it automatically when the free trial ends and at each applicable annual renewal until you cancel.

For the Founding Member offer described in these Terms, the initial post-trial charge is $99. While your qualifying Founding Member membership remains continuously active, the membership renews automatically at $99 per year, unless you cancel before the applicable renewal charge.

If a payment fails, we may retry the payment, request an updated payment method, suspend benefits, or terminate the membership. You are responsible for keeping your payment information current.

6. Founding Member $99 Annual Rate Lock

The Founding Member $99 annual rate is a promotional rate for eligible members who enroll during the Founding Member offer and maintain continuous paid membership after the trial.

Your $99 annual Founding Member rate remains locked for as long as the qualifying membership remains continuously active. If you cancel, allow the membership to expire, fail to maintain a valid payment method after reasonable payment attempts, or otherwise lose membership status, the Founding Member rate is forfeited. Any later re-enrollment is subject to the membership prices and terms then available, and the $99 Founding Member rate is not guaranteed to be reinstated.

This rate lock applies to the membership fee only. It does not guarantee any particular travel price, inventory, supplier, feature, benefit, tax, fee, or third-party charge.

7. Cancellation

You may cancel your membership through any cancellation method we make available, which may include your member account, a customer billing portal, or contacting Explore Occasions support. Cancellation requests should be completed before the applicable trial expiration or renewal date to avoid the next membership charge.

If you cancel during the 14-day free trial, your membership will not convert to the $99 paid annual membership. Unless otherwise stated at the time of cancellation, access may continue through the end of the trial or then-current paid membership period.

Except where required by law or expressly provided by the Founding Member Savings Guarantee below, membership fees already charged are non-refundable. Canceling a membership does not automatically cancel, refund, or modify any separate travel reservation.

8. Explore Occasions Founding Member Savings Guarantee™

Eligible Founding Members may qualify for our Founding Member Savings Guarantee™. To qualify, during the member’s initial 14-day trial the member must make one or more qualifying hotel, resort, and/or rental-car bookings through Explore Occasions with a combined qualifying booking value of at least $1,000, including mandatory taxes and fees displayed as part of the booked total.

If, after verification under the comparison rules below, the member’s total verified savings on those qualifying bookings do not exceed the $99 Founding Member annual membership fee, Explore Occasions will refund the member’s first $99 annual membership fee if it has been charged. If the fee has not yet been charged and we are able to verify eligibility before billing, we may instead waive that first-year fee. This guarantee applies only to the first annual membership fee and does not waive or refund travel charges.

How verified savings are determined

“Verified savings” means the positive difference, if any, between the total price actually booked through Explore Occasions and a publicly available comparable price that Explore Occasions can reasonably verify for the same travel product at or near the time of booking. A comparison must be materially like-for-like, including the same property or vehicle class, travel dates and times, occupancy or driver criteria, room or rate type where applicable, cancellation/refund terms, inclusions, mandatory taxes and fees, and other material booking conditions.

Prices that require a separate paid membership, private negotiated rate, employee rate, loyalty status not generally available to the public, coupon unavailable to the member, package-only rate that cannot be separately verified, pricing error, unauthorized or fraudulent rate, or materially different booking conditions may be excluded from the comparison.

Eligibility and claim requirements

The guarantee is limited to the original enrolled Founding Member, is not transferable, and may be used once. Canceled, refunded, fraudulent, duplicate, chargeback, test, or otherwise invalid bookings do not qualify. If a qualifying booking is canceled or materially changed, we may recalculate eligibility and savings.

A member requesting the guarantee must contact support@exploreoccasions.com within 30 days after the end of the initial 14-day trial and provide the booking information and any reasonably requested documentation necessary to verify the claim. We may verify comparable rates using time-stamped records, supplier data, publicly available pricing, or other reasonable evidence.

The guarantee does not promise that Explore Occasions will always have the lowest price for every travel product. It is a limited membership-fee guarantee subject to these eligibility and verification rules. Nothing in this section limits rights that cannot legally be waived.

9. Travel Bookings, Suppliers & Third-Party Terms

Travel inventory may be supplied, fulfilled, serviced, charged, or otherwise supported by third-party travel suppliers, booking platforms, payment providers, or other partners. The identity of the applicable provider may be displayed during the booking process or in booking documentation.

Travel reservations are subject to the applicable supplier’s rules, restrictions, availability, cancellation terms, refund rules, check-in requirements, age requirements, identification requirements, and other conditions. You are responsible for reviewing booking details before purchase and for complying with passport, visa, health, entry, insurance, and other travel requirements applicable to your trip.

Explore Occasions is not responsible for acts, omissions, insolvency, schedule changes, overbooking, service failures, property conditions, transportation disruptions, weather, governmental actions, or other matters controlled by third-party suppliers or events outside our reasonable control, except to the extent liability cannot be excluded by law.

10. Travel Pricing, Comparisons & Savings Information

Travel prices and availability can change rapidly and may differ based on dates, occupancy, inventory, location, device, currency, loyalty status, taxes, fees, cancellation terms, and supplier rules. A displayed comparison or savings amount is informational and is based on the data and comparison conditions available to us at the relevant time.

Unless expressly stated otherwise, Explore Occasions does not guarantee that a displayed travel rate is the lowest price available anywhere. “Retail,” “market,” “comparison,” “member,” and similar pricing labels may be based on supplier-provided or verifiable comparison data and should be evaluated together with the applicable booking terms and total price.

11. Service Changes, Availability & Technology

We may add, modify, suspend, replace, or discontinue features, suppliers, integrations, benefits, or portions of the service. We do not guarantee uninterrupted access, continuous availability of any supplier or inventory, or that every feature will be available in every location or at every time.

Features identified as artificial intelligence, travel intelligence, price monitoring, comparison tools, recommendations, scores, or similar technology are decision-support tools and may contain errors, delays, incomplete information, or changing data. You remain responsible for reviewing material travel and purchase information before acting.

12. Acceptable Use

You may not use Explore Occasions to violate law; commit fraud; interfere with security; scrape, copy, reverse engineer, or misuse protected systems or data; circumvent access controls; resell member-only access without authorization; impersonate another person; submit false claims; or abuse trials, promotions, pricing, refunds, guarantees, suppliers, or payment systems.

We may suspend or terminate access where reasonably necessary to protect customers, suppliers, our systems, or the integrity of the service.

13. Intellectual Property

Explore Occasions names, branding, site content, software, designs, and proprietary features are owned by or licensed to Explore Occasions and are protected by applicable intellectual-property laws. Explore Occasions product names may include Price Watch™, True Trip Price™, Better Deal Engine™, Better Deal Score™, Occasion Match Score™, and Member Savings Ledger™. No ownership rights are transferred to you by your use of the services.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EXPLORE OCCASIONS DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANY PARTICULAR TRAVEL INVENTORY, PRICE, SAVINGS, OR RESULT WILL ALWAYS BE AVAILABLE.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXPLORE OCCASIONS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST OPPORTUNITIES ARISING FROM OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO A MEMBERSHIP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE MEMBERSHIP FEES YOU PAID TO EXPLORE OCCASIONS DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100. THIS LIMIT DOES NOT APPLY WHERE SUCH A LIMITATION IS PROHIBITED BY LAW.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold Explore Occasions harmless from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful misuse of the services, your violation of these Terms, or your infringement of another person’s rights.

17. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. Before filing a formal claim, you and Explore Occasions agree to make a good-faith effort to resolve the dispute by contacting the other party and allowing a reasonable opportunity for resolution.

Unless applicable law requires otherwise, any court proceeding arising from these Terms will be brought in a court of competent jurisdiction in Florida. Nothing in this section prevents either party from seeking relief in small-claims court where eligible or from exercising rights that cannot legally be waived.

18. Privacy & Payment Processing

Our collection and use of personal information is described in our Privacy Policy. Payment information may be processed and stored by third-party payment processors, including Stripe, subject to their applicable terms and privacy practices. Explore Occasions may receive payment status, billing details, and other transaction information needed to administer your membership.

19. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated or posted as required by applicable law. Changes will not retroactively alter a completed transaction where prohibited by law. Your continued use of the services after updated Terms become effective constitutes acceptance to the extent permitted by law.

The Founding Member $99 annual rate lock described above remains governed by Section 6 while an eligible membership remains continuously active.
